Split verdict on Nizam Hazari’s JS seat

A High Court today delivered split verdict on a writ petition that challenged the legality of Awami League leader Nizam Uddin Hazari’s parliament membership.

Senior judge of the High Court bench, Justice Md Emdadul Huq, declared Hazari’s parliament membership illegal after accepting the writ petition.

The junior judge of the HC bench, Justice FRM Nazmul Ahasan, rejected the petition which implies that he declared the Jatiya Sangsad membership legal.

Hazari’s lawyer Barrister Shafque Ahmed told reporters that the bench will now send the writ petition along with the split verdict to the table of the chief justice.

The chief justice will constitute another High Court bench for the writ’s disposal.

Shakhawat Hossain Bhuiyan, a Jubo League leader of Feni, filed the petition with the HC on June 8, 2014 praying to the court to declare Nizam, an AL lawmaker of Feni-2 constituency, disqualified for contesting in the parliamentary polls and holding the office as a lawmaker for his alleged forgery in getting early release from jail in a criminal case.

He said in the petition that a Chittagong court on August 16, 2000 had sentenced Nizam to 10 years’ imprisonment in an arms case, but he served in the jail for only five years.

Nizam was sent to Chittagong jail after he surrendered to lower court on September 14, 2000 and he got released from jail on December 1, 2005 through fraudulence, he said in the petition.
